By inviting Zoe to your Discord server, interacting with the bot, or using any of its features, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

Zoe is an AI-powered conversational Discord bot that provides:

• Natural language conversations powered by OpenAI
• Customizable personality traits and interaction styles
• Server management and utility features
• Premium features including voice notes, advanced AI models, and unlimited messaging
• NSFW conversation support in age-restricted channels (18+ only)

3. User Eligibility

3.1 Age Requirements

• General Use: You must be at least 13 years old (Discord's minimum age requirement)
• NSFW Features: You must be at least 18 years old to use NSFW mode or interact in NSFW channels
• Premium Subscriptions: You must be at least 18 years old or have parental consent to purchase

3.2 Account Requirements

• You must have a valid Discord account in good standing
• You are responsible for all activity under your account
• One account per person - no multi-accounting for free messages

4. User Conduct and Acceptable Use

4.1 Prohibited Activities

You agree NOT to:

• Use the bot to harass, abuse, or harm others
• Attempt to bypass rate limits or abuse the service
• Use automated systems (bots) to interact with Zoe
• Exploit bugs or vulnerabilities for personal gain
• Share, resell, or redistribute premium features
• Reverse engineer, decompile, or attempt to extract source code
• Use the bot for illegal activities or violate Discord's Terms of Service
• Generate content that violates applicable laws
• Impersonate others or provide false information
• Use the service to spam or send unsolicited messages

4.2 NSFW Content

5. Rate Limits and Message Quotas

5.1 Free Tier

• Free users receive 5 messages per day
• Daily quotas reset at midnight UTC
• Limits may be adjusted at our discretion

5.2 Voting Rewards

• Voting on top.gg grants 30 messages per day
• Vote benefits last for 12 hours
• Voting is optional and may be disabled by the bot operator

5.3 Premium Tier

• Premium subscribers receive significantly increased message limits
• An anti-abuse limit (default: 500 messages/day) applies to prevent service abuse
• Users who repeatedly hit abuse limits may face account review

6. Premium Subscriptions

6.1 Payment and Billing

• Premium subscriptions are processed through Stripe
• Payment is charged monthly or yearly based on your selection
• All fees are non-refundable except as required by law
• Prices are subject to change with 30 days notice

6.2 Subscription Terms

• Subscriptions automatically renew unless cancelled
• You may cancel anytime through the Stripe customer portal
• Cancellation takes effect at the end of the current billing period
• Premium features remain active until subscription expires

6.3 Refund Policy

• Subscriptions are generally non-refundable
• Refunds may be issued at our sole discretion for service failures
• Contact support within 7 days of charge for refund requests
• Chargebacks may result in permanent service ban

• The name "Zoe" and associated branding are our property

8.2 Your Content

• You retain ownership of messages you send to the bot
• You grant us license to process your messages for AI responses
• We may use anonymized data for service improvement

9. Service Availability

9.1 Maintenance and Downtime

• We may perform scheduled maintenance with notice when possible
• Emergency maintenance may occur without notice
• Premium subscription time is not extended for downtime

10. Termination

10.1 Your Rights

• You may stop using the service at any time by removing the bot
• You may delete your data using the appropriate commands
• You may cancel premium subscriptions at any time

We reserve the right to:

• Suspend or terminate your access for violating these Terms
• Remove the bot from servers that violate Discord TOS
• Refuse service to anyone at our discretion
• Discontinue the service entirely with 30 days notice

• NSFW mode provides uncensored content - use at your own risk
• We are not responsible for AI-generated NSFW content
• NSFW features must only be used in appropriate, age-restricted channels
• OpenAI's usage policies still apply and may filter certain content

Zoe integrates with third-party services including:

• Discord: Subject to Discord's Terms of Service
• OpenAI: Subject to OpenAI's Usage Policies
• Stripe: Subject to Stripe's Terms of Service
• Top.gg: Subject to Top.gg's Terms of Service
• ElevenLabs: Subject to ElevenLabs' Terms of Service

We are not responsible for third-party service failures or policy violations.
